Terms of Service

These Terms of Service ("Terms") govern your access to and use of RESA HELPS, the IT service-management application operated by St. Clair County Regional Educational Service Agency ("SCCRESA," "we," "us," or "our").

1.Acceptance of these terms

By accessing or using RESA HELPS, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not access or use the application. If you use RESA HELPSon behalf of an organization, you represent that you are authorized to accept these Terms on that organization’s behalf.

2.The service

RESA HELPS is an internal IT service-management platform that provides helpdesk ticketing, asset and inventory tracking, project management, and a staff in/out availability board. SCCRESA provides it for its own staff and for the school districts, intermediate school districts, municipalities, colleges, non-profits, and other partner organizations it serves.

3.Eligibility and accounts

RESA HELPS is a restricted system. Access is limited to individuals who have been provisioned and authorized by SCCRESA or by a participating organization. Sign-in is deny-by-default, and there is no open self-registration. The application is not intended for use by students or by children, and you must be an authorized user to access it.

You are responsible for:

  • Keeping your sign-in credentials confidential and secure.
  • All activity that occurs under your account.
  • Promptly notifying us of any unauthorized use of your account or any other security concern.

Do not share your account or let anyone else use your credentials.

4.Acceptable use

You agree to use RESA HELPS only for legitimate IT support and related institutional purposes, and you agree that you will not:

  • Violate any applicable law or any SCCRESA or organizational acceptable-use, technology, or data policy.
  • Attempt to gain unauthorized access to the application, other accounts, or any connected system or network.
  • Probe, scan, or test the vulnerability of the system, or breach or circumvent any security or authentication measure.
  • Disrupt or interfere with the integrity or performance of the service, or impose an unreasonable load on it.
  • Reverse engineer, decompile, scrape, or copy the application except as permitted by law.
  • Upload or transmit unlawful, infringing, malicious, or harmful content, including malware.
  • Submit other people's sensitive personal information beyond what is reasonably necessary to make or resolve a request.
  • Use the application to harass, threaten, defame, or harm any person.

5.Your content

You and your organization retain whatever rights you hold in the content you submit to RESA HELPS (such as ticket text and attachments). You grant SCCRESAthe right to store, process, display, and use that content as necessary to operate and provide the service.

You are responsible for the accuracy and lawfulness of what you submit. Do not submit student education records or other sensitive information except to the extent reasonably necessary to obtain IT support, and only in a manner consistent with your organization’s policies and applicable law. Our handling of personal information is described in the Privacy Policy.

6.Service availability and changes

RESA HELPSis provided on an “as is” and “as available” basis.SCCRESA may modify, suspend, limit, or discontinue any feature, perform maintenance, and impose usage limits at any time. The application is self-hosted, and we do not guarantee that it will be uninterrupted, timely, secure, or error-free.

7.Intellectual property

The RESA HELPSapplication, including its software, design, and trademarks (such as the “RESA HELPS” name and wordmark), is owned by SCCRESA or its licensors. Subject to these Terms, you are granted a limited, revocable, non-exclusive, non-transferable right to use the application for authorized purposes. No other rights or licenses are granted.

8.Third-party services

RESA HELPS relies on third-party providers, including sign-in providers (Google and, where enabled, Microsoft) and infrastructure providers. Your use of those providers is governed by their own terms and policies. We are not responsible for third-party services and do not control them.

9.Disclaimer of warranties

To the fullest extent permitted by law, RESA HELPS is provided without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. SCCRESA does not warrant that the application will meet your requirements or that any defects will be corrected.

10.Limitation of liability

To the fullest extent permitted by law, SCCRESA and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or relating to your use of (or inability to use) RESA HELPS. As a Michigan public agency, nothing in these Terms waives, limits, or modifies any governmental immunity or other protection or defense available to SCCRESA under Michigan law.

11.Suspension and termination

We may suspend or terminate your access to RESA HELPSat any time — including for violation of these Terms, for security reasons, or at the direction of SCCRESAor your organization. You may stop using the application at any time. Provisions that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and governing law) will survive.

12.Changes to these terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and post the new version on this page. Your continued use of RESA HELPS after a change takes effect constitutes acceptance of the updated Terms.

13.Governing law and venue

These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. To the extent permitted by law, any dispute arising out of or relating to RESA HELPS or these Terms will be brought exclusively in the state or federal courts located in St. Clair County, Michigan, and you consent to the jurisdiction of those courts. These Terms are also subject to the laws governing Michigan public and governmental entities.

14.Public-records notice

SCCRESA is a Michigan public educational service agency. Communications and records within RESA HELPS may constitute public records subject to the Michigan Freedom of Information Act and applicable records-retention requirements.
